Welcome to WhatsAuction. These Terms of Service ("Terms") govern your access to and use of the WhatsAuction platform, website, and related services (collectively, the "Service") operated by WhatsAuction ("we", "us", "our"), accessible at whatsauction.co.za.

WhatsAuction offers a free tier with limited features and paid subscription plans with additional capabilities. Plan details and pricing are available on our website and may change with reasonable notice.
Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan). Payments are processed securely through PayFast, a South African payment gateway. By subscribing, you authorise recurring charges to your selected payment method.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except where required by South African consumer protection law.
We may adjust pricing with at least 30 days' written notice. Continued use after a price change constitutes acceptance of the new pricing.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may use WhatsAuction to manage legitimate auctions, track bids, generate invoices, and communicate with bidders through linked WhatsApp groups.

All content, code, designs, logos, trademarks, and materials associated with WhatsAuction are our exclusive property or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
You retain ownership of any content you upload (such as lot descriptions, images, and auction details). By uploading content, you grant us a non-exclusive, worldwide licence to use, display, and process that content solely for the purpose of operating the Service.

You agree to indemnify and hold harmless WhatsAuction and its team from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of the Republic of South Africa.
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
